The location of the person’s domicile, residence and nationality can all impact on the due administration of a deceased's estate.

Once both the domicile and residence are known, Sinels can advise on the process and paperwork the appointed person will need to follow to reach settlement of the estate as quickly as possible.

Location of Assets

Sinels advise on and will act on all requirements and applications for probate, whether in Jersey or in other jurisdictions. Orders of the local courts in each of the relevant jurisdictions will be needed for the transfer of assets to be completed within those locations. It’s important to have a clear idea of all the assets and their location and it really helps to have separate wills for each jurisdiction.

Jersey Law

Probate applications that are made through the Jersey court require the attendance in person of either the executor or a Jersey advocate. Since the settling of cross-border estates can at times be complex, it can happen that the Jersey court makes a request that a special requirement is fulfilled before the probate is granted. Will Disputes

Disputes regarding the will of a loved one who has died can arise through either a conflict among the beneficiaries of an estate or through an executor’s apparent incapacity or failure to act in accord with the wishes of the deceased or adhere to the requirements of probate. Probate Applications

Private wealth and the affairs of wealthy individuals and families often have an international dimension. There are often quite significant undertakings to fulfil the last wishes of a loved one’s estate including, in Jersey and similar jurisdictions, applying for a Grant of Probate. For the appointed person, this provides the legal right to administer the estate. This process is commonly referred to as probate.
